Welcome to Weight Trekker! These Terms of Use ("Terms") govern your use of our mobile application (the "App"), operated by Equation AB ("we," "our," or "us"). By accessing or using the App, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. Eligibility

To use the App, you must be at least 13 years old. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are under the age of 18, you may use the App only with the involvement of a parent or guardian.

3. User Account

To access certain features of the App, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of the App

Permitted Use

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the App for personal, non-commercial purposes only. You agree to use the App in accordance with these Terms and any applicable laws or regulations.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Copying or Modifying the App: You must not modify, copy, distribute, or create derivative works of the App or its content.
• Reverse Engineering: Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.
• Unauthorized Access: Attempt to gain unauthorized access to the App, user accounts, or computer systems or networks connected to the App.
• Data Mining: Use any automated means, such as robots, scrapers, or data mining tools, to access, collect, or analyze data from the App.
• Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Harmful Conduct: Engage in conduct that could harm, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the App.

5. User-Generated Content

Responsibility

You are solely responsible for any content you submit, post, or display on or through the App, including but not limited to weight logs, comments, or feedback ("User Content"). By submitting User Content, you represent and warrant that you have all necessary rights and permissions to do so.

License

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the App and our business operations.

Prohibited Content

You agree not to post or share User Content that:

• Is illegal, harmful, abusive, defamatory, or otherwise objectionable.
• Infringes upon any intellectual property rights or privacy rights of others.
• Contains viruses, malware, or any other harmful code.

6. Intellectual Property Rights

Ownership

All rights, title, and interest in and to the App and its content, including but not limited to software, text, images, graphics, and trademarks, are owned by or licensed to us. You agree not to reproduce, distribute, or create derivative works based on the App's content without our express written permission.

Feedback

Any feedback, suggestions, or ideas you provide regarding the App ("Feedback") will be considered non-confidential and non-proprietary. By providing Feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, modify, and incorporate such Feedback into our products and services.

7. Privacy

Your use of the App is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers

Health and Fitness Disclaimer

Weight Trekker is designed to assist you in tracking your weight loss journey. However, the App is not a substitute for professional medical advice, diagnosis, or treatment. You should consult with a healthcare provider before making any decisions related to your health and fitness. Use the App at your own risk, and always prioritize your health and safety.

No Warranty

The App is provided on an "as-is" and "as-available" basis, without any warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, secure, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses.

10. Indemnification

You agree to indemnify, defend, and hold harmless Equation AB, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your access to the App, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease, and any data associated with your account may be deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts of Sweden.

13. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App. Your continued use of the App following the posting of changes constitutes your acceptance
